Every Australian employer now has explicit, enforceable duties to identify, assess and control psychosocial hazards. The national picture completed when Victoria's psychological health regulations took effect on 1 December 2025.
In NSW, from 1 July 2026, the Managing Psychosocial Hazards at Work Code of Practice becomes an enforceable benchmark. That means regulators no longer need to prove harm occurred, and falling short of the Code can itself be a breach.
